1. Introduction

Welcome to OreCharm (“OreCharm”, “we”, “our”, or “us”).

OreCharm is an online marketplace that enables users to buy, sell, and discover preloved fashion, homeware, books, electronics, lifestyle products, and other approved items.

By accessing or using OreCharm, you agree to be bound by these Terms and Conditions.

If you do not agree to these Terms, you must not use our platform.

2. Eligibility

To use OreCharm, you must:

• Be at least 18 years old or have parental consent.

• Provide accurate registration information.

• Maintain the security of your account credentials.

• Comply with all applicable laws and regulations.

Users are responsible for all activity conducted through their accounts.

3. OreCharm Marketplace Service

​

OreCharm acts solely as a marketplace platform connecting buyers and sellers.

OreCharm is not the owner of items listed for sale and is not a party to transactions between buyers and sellers except where payment processing, dispute management, or platform services require our involvement.

4. Seller Accounts

​

Sellers may create listings and offer approved products for sale.

Sellers agree to:

• Accurately describe all items.

• Upload genuine photographs.

• Disclose defects or damage.

• Ensure items comply with applicable laws.

• Ship sold items within the stated timeframe.

OreCharm reserves the right to remove listings that violate these Terms.

 

5. Seller Subscription

​

New sellers receive three (3) months of free access to OreCharm’s selling platform.

After the free period, sellers will be charged a subscription fee of £1 per month to continue listing unlimited items.

Subscription fees:

• Are billed monthly.

• Renew automatically unless cancelled.

• Are non-refundable except where required by law.

Sellers may cancel at any time through their account settings.

 

6. Seller Fees

OreCharm may charge:

Protection / Administration Fee

A fixed fee applied to completed transactions to support:

• Buyer protection services

• Platform administration

• Fraud prevention

• Customer support

Transaction Fee

A percentage fee deducted from each completed sale.

Current fees are displayed within the seller dashboard and may be updated periodically.

Continued use of OreCharm following fee changes constitutes acceptance of the revised fees.

 

7. Buyer Purchases

Buyers agree to:

• Provide accurate payment information.

• Pay all applicable charges.

• Review item descriptions before purchasing.

• Communicate respectfully with sellers.

Once payment is completed, a purchase contract is formed between the buyer and seller.

 

8. Payments

​

Payments are processed through approved third-party payment providers.

OreCharm does not store full payment card details.

Funds may be held temporarily where necessary to:

• Verify transactions

• Prevent fraud

• Resolve disputes

 

9. Buyer Protection

​

Eligible purchases may be covered by OreCharm Buyer Protection.

Buyer Protection may apply where:

• Items do not arrive.

• Items are significantly different from the listing description.

• Fraudulent activity is identified.

OreCharm reserves the right to investigate claims and determine eligibility.

 

10. Shipping and Delivery

​

Sellers are responsible for:

• Packaging items appropriately.

• Dispatching items within advertised timeframes.

• Providing tracking information where available.

Delivery times are estimates only.

OreCharm is not liable for delays caused by carriers or circumstances beyond reasonable control.

 

11. Returns and Refunds

​

Return policies are determined by the seller unless otherwise required by law.

Buyers should review listing-specific return information before purchasing.

OreCharm may intervene where disputes arise concerning:

• Non-delivery

• Misrepresentation

• Fraudulent conduct

 

12. Prohibited Items

​

The following may not be listed on OreCharm:

• Counterfeit goods

• Stolen items

• Illegal products

• Weapons

• Hazardous materials

• Adult content

• Prescription medications

• Items that infringe intellectual property rights

OreCharm reserves the right to remove prohibited listings without notice.

 

13. User Conduct

​

Users must not:

• Provide false information.

• Manipulate ratings or reviews.

• Harass other users.

• Attempt unauthorised access to the platform.

• Use automated scraping tools without permission.

 

14. Intellectual Property

​

The OreCharm name, branding, logos, website content, and design elements are owned by OreCharm or its licensors.

Users may not reproduce or distribute platform content without permission.

 

15. Suspension and Termination

​

OreCharm may suspend or terminate accounts that:

• Breach these Terms.

• Engage in fraudulent activity.

• Pose security risks to the platform.

Termination does not affect outstanding obligations or fees.

 

16. Limitation of Liability

​

To the fullest extent permitted by law, OreCharm shall not be liable for:

• Indirect or consequential losses.

• Loss of profits.

• User disputes.

• Errors in listings created by users.

Nothing in these Terms excludes liability where exclusion is prohibited by law.

 

17. Privacy

​

Use of OreCharm is also governed by our Privacy Policy and Cookie Policy.

By using the platform, users acknowledge how personal information is collected and processed.

 

18. Changes to Terms

​

OreCharm may update these Terms from time to time.

Updated versions will be published on the website with a revised effective date.

Continued use of OreCharm constitutes acceptance of updated Terms.

 

19. Governing Law

​

These Terms shall be governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
